NHB Assignments, LLC, a wholly owned subsidiary of NachmanHaysBrownstein, Inc. (“NHB”) has been appointed Plan Administrator to oversee the liquidation of Montgomery Ward, LLC et al. (“Wards”), the largest retail bankruptcy liquidation in U.S. history.
This liquidation is proceeding pursuant to the Third Amended Plan of Liquidation filed by the Official Committee of Unsecured Creditors of Montgomery Ward, LLC, et al., which was confirmed by the U.S. Bankruptcy Court for the District of Delaware by order entered on August 20th, 2002 (Case No. 00-4667 (RTL), the “Plan”). The Effective Date of the Plan is October 10th, 2002.

NHB is responsible for winding down the remaining activities of Wards, managing the estate’s assets, and disbursing assets to creditors in accordance with the Plan. Howard Brod Brownstein, CTP, Principal of NHB, and John L. Palmer, CTP, Managing Director of NHB, are responsible for managing this engagement. The Montgomery Ward’s Plan Administration Committee announces a fifth interim disbursement, effective 12/9/05 to holders of allowed general unsecured claims consisting of an additional 3% of the claim amount. This fifth interim disbursement brings total payments to unsecured creditors to 32%. The Plan Administration Committee expects to make an additional Final disbursement at the conclusion of the bankruptcy case. However, all outstanding issues must be resolved before the case can be closed and the final disbursement held. Therefore, it may be a year or more before the final disbursement is held.
You do not need to do anything to receive this final disbursement. However, if you move, be sure to send your new address to John L Palmer by email or at the address listed below.

The Bankruptcy Court has issued an Order intended to streamline creditor disbursements. One aspect of this Order is that the Plan Administrator will not be issuing checks less than $25. Creditors with small claims will not lose any amount due. Rather, payments to these creditors will accumulate and will be mailed once the amount due reaches $25 or more. Creditors who wish to receive checks under $25 may do so by contacting John L. Palmer. |

This Order also creates a group of Lost Unsecured Creditors, whose checks were returned in the mail, or whose previous disbursement check(s) remain uncashed, or who have not responded to a solicitation requesting a tax identification number. If you hold an allowed general unsecured claim greater than $416.67, you should receive a disbursement in the fifth round. If you did not receive a disbursement during 2005, you may be included in this Lost Creditor group. Please contact John L. Palmer and provide your name, your current address and tax identification number. You will be included in a monthly catch up disbursement if you were listed as a Lost Creditor, but were otherwise eligible to receive a distribution. |
